California Supreme Court Rejects "Stray Remarks" Doctrine

(10/04/10) The California Supreme Court allowed ex-Google engineer Brian Reid's case to move forward after Google tried to have it dismissed. Google argued that remarks made by other employees about Reid's age weren't sufficient proof his termination was age-related under the "stray remarks" doctrine, and that the company's "culture" can require a youthful attitude and demeanor as a bona fide occupational qualification. The California Supreme Court did not like either of those arguments.
